Se negó la petición de aclaración presentada por el apoderado de la demandada en el proceso de la referencia, toda vez que le corresponde conocerla y definirla a la justicia ordinaria, pues la tutela es una acción que consagra el Art. 86 de la C.P., para proteger los derechos fundamentales de las personas, de lesiones o amenazas de vulneración por parte de una autoridad pública y, bajo ciertos supuestos, por parte de un particular, siendo entonces un procedimiento judicial autónomo, directo y sumario, que en ningún caso puede sustituir los procesos judiciales que establece la ley, pues dicha acción no es una institución procesal alternativa ni supletiva.
